If an AI system presents a risk, the market surveillance authority of a Member State will carry out an evaluation of the AI system. If the system does not comply with the requirements, the authority will require the operator to take corrective actions. If non-compliance is not restricted to its national territory, the authority will inform the Commission and the other Member States.
