GR1X1S,
I ran into this same issue previously when the kernel wasn't flashed and the chroot was mounted at boot. (The kernel modifies the ramdisk to enable init.d + /data/local/userinit.sh).
Can you verify that the kernel was flashed?

The kernel version listed is 3.4.95-furnace-1.3.6 root@kali #1

Yep, that's it. Could you also tell me if you are running stock (or did you use a custom ROM), which device you are running also. I assume its the Nexus 5 based on the kernel but just want to double check you are running version 4.4.4 also.

Okay I was wondering if 4.4.4 was my problem. I hadnt got around to updating that OS version. Its stock but has been updated. Im assuming I need to unroot, update, re-root. Yeah its the nexus 5 (hammerhead)

Okay so I flashed a 4.4.4 stock OS and then flashed the Kali zip again and all works fine now. Thanks binkybear. :)
