That favicon is 16x16 and not really high enough quality.
The one that was recently added (64x64) to make a good Desktop icon too (using Chrome's Application feature) is definitely transparent as I made it and use it all the time...

I'm sorry i didn't check this in multiple browsers. Apparently only Opera got problems with the favicon. It looks like Opera isn't able to resize the 64x64 favicon to 16x16 properly. I made an image of it:
So it's probably an opera bug (IE9, FF10, Safari and Chrome work fine).
edit: When i save the favicon it saves the 64x64 favicon. It's just that Opera shows a ugly resized one.
