I would guess that you need to update these 2 lines https://github.com/microsoft/vstest/blob/main/eng/SourceBuildPrebuiltBaseline.xml#L18-L19 to target 8.0.1
instead of 8.0.0
.
There is no way for us to remove these prebuilt as long as we are inserted into both net8 and net9.

Yup. the exclusions were okayed, because we are excluding net8 bits when building for net9, and we cannot avoid restoring the net8 bits.
