woops fixed :) I had JAVA_HOME set "...\Java\jdk1.7.0" path, JFX_DIR set to "...\Java\Jre7\lib" path so JRuby was using "Java HotSpot(TM) Client VM 1.7.0-b147".
now I set JAVA_HOME to "...\Java\jre7" and jruby -v reports "..on Java HotSpot(TM) Client VM 1.7.0_13-b20 " and everything works fine.. feel free to delete this :)
